HC verdict on holding PR polls today
Hyderabad, June 13(Hyderabad Deccan News): The AP High Court will deliver its verdict on the validity of the state's decision to provide 60 per cent political reservations to weaker sections in the ensuing elections to panchayats and other local bodies, on Tuesday. Justice G. Rohini was dealing with a petition by state sarpanches association challenging the action of the government. The petitioner's association contended that the action of the government goes against the directive of the Supreme Court that made it mandatory for the states to ensure that the total percentage of reservations does not cross 50 per cent of the total seats.
Mr S. Ramachandra Rao, senior counsel arguing on behalf of the petitioner told the court that the state's decision will cross the limit fixed by the apex court. He said it was unlawful and urged the court to strike down the state's decision. The additional advocate-general, Mr B. Bhaskara Rao, told the court that the issue of providing reservations to weaker sections like SC, ST and BCs is nothing new. It has been going on for the last 15 years in the state with BCs getting 34 per cent, SCs 18 per cent and STs 8.5 per cent. Mr U.V. Chakravarthi, president of Most Backward Classes Committee and Mr U. Sambasiva Rao, co-convener of the BC-A Kulala Hakkula Parirakshana Samiti impleaded themselves in the case and urged the court to allow the state to implement the 60 per cent reservations for BCs. Mr A. Ramalingeswara Rao, counsel arguing on their behalf found fault with the petitioner in this case for challenging the decision of the state without challenging the statute that was providing such reservations.
Elsewhere, a division bench comprising of Chief Justice Nisar Ahmed Kakru and Justice Vilas Afzulpurkar were not inclined to grant interim orders to stay the election process for the ensuing elections for the local bodies. The bench was dealing with the writ petition filed by Mr U. Sambashiva Rao. He complained to the court stating that various categories among Backward Communities are not being given separate reservation in the local bodies. The bench ordered notice and made it clear stay can not be granted now.
HC to decide on CAT order on DGP
The AP High Court will pronounce its decision on Tuesday on whether to stay the Central Administrative Tribunal's verdict that was passed against the appointment of the director-general of police, Mr K. Aravinda Rao, before final hearing or straightaway hear the matter without staying the order. A division bench comprising Chief Justice Nisar Ahmad Kakru and Justice Vilas V. Afzulpurkar were dealing with a petition filed by the state government challenging the CAT order.
The Chief Justice said he would admit the petition, stay the judgement and finally adjudicate the matter later. Mr C.V. Mohan Reddy, the senior counsel appearing for Mr P. Gautam Kumar, principal secretary to home department, opposed the stay and said, "It is your prerogative to admit the petition and post it for final adjudication. But the idea of staying the CAT judgement would amount to staying a judgement of a division bench of this court which is an identical case of Mr Girish Kumar versus Mr S.S.P. Yadav. He said it would also amount to staying the order of the Supreme Court in Mr Prakash Singh case which laid down the procedure to be followed in the matters pertaining to the appointment of DGP (head of police force).
Mr A. Sudharsan Reddy, advocate-general said after the retirement of the current DGP, the government will follow the procedure.
