HC rejects Jagan plea, directs CBI to go ahead with probe


Hyderabad, August 10(Hyderabad Deccan News): The Andhra Pradesh High Court has directed the CBI to register criminal cases against the Kadapa MP, and YSR Congress Chief, Mr Y S Jagan Mohan Reddy, for alleged amassment of wealth.
A division bench, comprising the Chief Justice, Mr Nissar Ahmed Kukroo, and Mr Justice Vilas Afzal Purkar, on Wednesday pronounced the judgment which was reserved last week after completion of arguments by both the sides in the cases of Mr Jagan and EMAR Properties. The Court also directed CBI to register cases against Mr Jagan under Anti-Corruption and Money Laundering Acts and conduct full-scale probe into both cases.
A letter written by the Textiles and Handlooms Minister, Mr P Shankar Rao, alleging that Mr Jagan had amassed properties worth thousands of crores of rupees by misusing power and also on EMAR's irregularities was treated as a writ petition by the court.
The other two writ petitions on the issue were filed by senior TDP leader, Mr Yerrannaidu and an Advocate, Mr Sherwani of Kadapa. The Minister in his letter made allegations against the deal between the APIIC and EMAR Properties.
Later the High Court ordered a preliminary report in these cases.
Acting on the directions by the court on July 12, the CBI had submitted a preliminary report in the two cases in the last week of July in a sealed cover.
After the arguments were completed last week, the bench opened the sealed envelop and perused the papers and ordered sealing of the cover once again.
The court observed that there was prima facie evidence on the misuse of thousands of crores of rupees allegedly by Mr Jagan and rejected handing over the CBI's preliminary to the accused, who is the son of former Chief Minister Dr. Y S Rajasekhara Reddy.
The High Court has however rejected the petition of Mr Sherwani on technical grounds and expressed anguish that it would not be a silent spectator when there were any irregularities.
Reacting to the High Court's direction, Mr Shankar Rao told reporters "I salute the judges and Baba Saheb Ambedkar as justice had prevailed at least through the court.' He alleged that Mr. Jagan has misused power and position through ill-gotten wealth.
The Advocate for the minister, Mr C. Mallesh Rao, said "the High Court judgment would be a fitting lesson to those who commit irregularities in public life.
The TDP leader, Mr Yerrannaidu, has said that the allegations made against Mr Jagan on his ill-gotten wealth were finally proved to be true.
The Health Minister and bAate noir of Mr Jagan, Dr D L Ravindra Reddy, said that the truth would come out after the completion of the investigation by the CBI visa-a-vis 2G Spectrum case.
The CBI official while conducting the preliminary inquiry had sent notices to 23 companies of which 22 companies had replied that they had invested in Mr Jagan's firms.
